Insurance is an ugly business. New York’s gigantic insurance companies make huge profits by denying as many claims as possible. As an injured motorist, you need to be aware of the different dirty tricks insurance adjusters use. Your ability to counter them effectively will make the difference between receiving a favorable settlement—and possibly receiving no compensation at all.

Watch Out for Broad Requests for Medical Records

To better understand your injuries, an insurer might ask for you to sign a release allowing them to get ahold of medical records. However, you need to be careful about what you authorize. Some insurance adjusters use them as a fishing expedition. In particular, they are looking for a pre-existing condition that they can blame for your injury.

Think of it this way. If you are suffering from a dislocated hip, the insurance company will be on the lookout for any previous hip problems. Don’t be surprised if that strange car parked on the curb with the tinted windows has a private investigator inside recording you.

Some insurance carriers also hire people to comb through your social media accounts, looking for evidence to use. For example, if you went on a trip to New Jersey, the carrier might claim you are exaggerating your injuries because you traveled. Remember to set your social media accounts to private and not to post anything about your injuries.

Avoid any Suggestion You Don’t Need a Lawyer

Some insurance adjusters might offer “friendly” advice that you don’t need a car accident lawyer. They might even tell you that you’ll get more money if you forego having an attorney.

The truth is usually far different. Without an experienced lawyer, you will not effectively negotiate a fair settlement for your injuries. In fact, you might settle for far less than you are entitled to. Remember: if you agree to a settlement, you will waive any ability to get compensation in the future for your injuries from the defendant.
