Brooklyn Jury Awards $5M in Medical Malpractice Case
In a complicated case medical malpractice case involving both a surgical error as well as a missed diagnosis, Brooklyn jurors found the defendants guilty of medical injury, but not for the death that resulted from it, and the plaintiffs were awarded $5,000,000. The plaintiffs in the case were the family of a Brooklyn, NY woman who developed a urine leak after a kidney transplant operation. The problem went undiagnosed for weeks, leading to her returning to dialysis, losing her new kidney, and ultimately her death. The award comes almost 18 years after the initial operation for the kidney transplant.
This jury award shows the nature of, and possible outcome, of medical malpractice and the harm it can cause to patients and their families. From misdiagnosis, to sponges being left in the body after surgery, it shows the life changing aspects of negligence, injuries, and accidents related to the medical field. Another recent medical malpractice case with completely different circumstances involves a couple who are suing a fertility clinic claiming that the clinic implanted the couple’s frozen embryo in another woman, who ended up baring the child. This extreme case has affected many people, from the couple, the birth mother, their families, and the new born child. It again reminds us just how agonizing and traumatic one medical error can be for so many people. All medical professionals have a professional duty to pay close attention to their work; when they perform negligently, many people can suffer.
